Tier 1 Sportsmen Giveaway – Official Rules

1. Sponsor
The Giveaway (“Promotion”) is sponsored by Tier 1 Sportsmen, a DBA of Colby Enterprises LLC (“Sponsor”).

2. Eligibility
The Promotion is open only to legal residents of the United States who are 18 years of age or older at the time of entry. Void where prohibited by law.
Employees, officers, directors, contractors, and immediate family members of Sponsor are not eligible to enter or win.
Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding.
3. Promotion Period
Each Promotion begins at 12:00 a.m. Central Time on the 1st day of the applicable month and ends at 11:59 p.m. Central Time on the 25th day of that same month (“Promotion Period”).
Entries submitted after the close of the Promotion Period will not be eligible for that month’s drawing.
4. How to Enter
A. Points-Based Entry (Members)
Eligible members may enter the Promotion by voluntarily applying Tier 1 Sportsmen points to the active Promotion during the Promotion Period.
- Each point applied equals one (1) entry.
- Applying points is not automatic and requires deliberate action by the member.
- Points have no cash value, are non-transferable, and cannot be refunded or reused once applied.
B. Free Method of Entry (No Purchase Required)
No purchase is required to enter or win.
Individuals may enter the Promotion by creating a free Tier 1 Sportsmen membership. Each free member will receive one (1) free point on the 1st day of each calendar month, which may be voluntarily applied as one (1) entry into the active Promotion.
Creating a free membership does not require payment or purchase of any kind, and the free monthly point provides the same chance of winning per entry as any other entry.
Limit one (1) free point per free member per month.
5. Entry Limitations
Unless otherwise stated, there is no limit to the number of entries per person; however, automated, scripted, or fraudulent entries are prohibited and will result in disqualification.
Sponsor reserves the right to disqualify any entrant who tampers with the entry process or violates these Rules.
6. Prizes
Prize details, quantities, and approximate retail value (“ARV”) will be disclosed in the Promotion announcement for each Giveaway.
Prizes are non-transferable and may not be substituted or redeemed for cash except at Sponsor’s sole discretion or where required by law. Sponsor reserves the right to substitute a prize of equal or greater value.
7. Winner Selection
Winner(s) will be selected at random from all eligible entries shortly after the Promotion Period ends. Odds of winning depend on the total number of eligible entries received.
8. Winner Notification
Potential winner(s) will be notified via the email address provided at entry or associated with their Tier 1 Sportsmen account.
Winner(s) must respond within 72 hours of notification. Failure to respond may result in forfeiture and selection of an alternate winner.
9. Verification & Taxes
Sponsor may require winner(s) to complete an affidavit of eligibility and a liability/publicity release where permitted by law.
Winner(s) are solely responsible for all federal, state, and local taxes associated with prize receipt.
10. Publicity Release
By accepting a prize, winner(s) grant Sponsor permission to use their name, username, likeness, and prize information for promotional and marketing purposes without additional compensation, unless prohibited by law.
11. Limitation of Liability
By participating, entrants agree to release and hold harmless Sponsor and its affiliates from any claim or liability arising from participation in the Promotion or acceptance, possession, or use of any prize.
Sponsor is not responsible for lost, late, incomplete, misdirected, or corrupted entries, or for technical or human errors of any kind.
12. Disqualification
Sponsor reserves the right to disqualify any entrant who:
- Violates these Official Rules
- Engages in fraudulent, deceptive, or unethical conduct
- Attempts to manipulate the Promotion or entry system
13. Privacy
Information collected in connection with the Promotion will be used solely for administering the Promotion and awarding prizes, and will be handled in accordance with Sponsor’s Privacy Policy.
14. State-Specific Registration & Compliance
Certain states require registration or bonding if the total combined retail value of all prizes exceeds specific thresholds:
- New York: Registration and winner disclosure may be required if the total prize value exceeds $5,000.
- Florida: Registration and bonding may be required if the total prize value exceeds $5,000.
- Rhode Island: Registration may be required if the total prize value exceeds $500 and the Promotion is retail-based.
Sponsor reserves the right to take any action necessary to comply with applicable state laws, including modifying eligibility or prize structure.
15. General Conditions
Sponsor reserves the right to cancel, suspend, or modify the Promotion if fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Promotion.
16. Governing Law
This Promotion is governed by the laws of the State of Texas, without regard to conflict-of-law principles.
