Welcome to Tier 1 Sportsmen, (“Tier 1 Sportsmen,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of our website, Tier1Sportsmen.com, related subdomains, online membership platform, digital content, products, and services (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Acceptance of Terms

By using Tier 1 Sportsmen (an entertainment and outdoors community operated by Colby Enterprises LLC), you agree to these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, do not use the Site. Your use of the Site constitutes your acceptance of any updates to these terms. Note that a Privacy Policy, which explains our data practices, is maintained separately (as required by law)

Account Registration and Membership

You may be required to register and create an account to access certain Site features. You agree to provide accurate, current and complete information. You are responsible for safeguarding your account credentials (username and password) and for all activities under your account. You must be at least 18 years old to register or use this Site. One account per person is allowed; you may not share accounts or impersonate others. Tier 1 Sportsmen reserves the right to suspend or terminate any account for any reason, including if information is fraudulent or if you violate these Terms.

Free Membership: Provides access to general content, forums, and point-earning opportunities at no cost.
Premium Membership: (Optional) Unlocks additional content and higher point-earning rates in exchange for a recurring subscription fee. Premium subscriptions renew automatically until canceled. All membership fees are charged through our payment processor. Premium members must cancel before the next billing cycle to avoid additional charges.

You agree to keep your password confidential and are responsible for all use of your accounttermly.io. You agree to notify us immediately of any unauthorized use of your account. Tier 1 Sportsmen is not responsible for any losses or damages arising from use of your account by others.

Points and Giveaways

Members earn Points for various activities (e.g. site engagement, referrals, etc.) which can be used to enter contests, sweepstakes or giveaways on the Site. Points are a non-cash rewards currency and carry no monetary valuetheginguide.com. Points cannot be redeemed for cash, and have no cash equivalent. All prizes and giveaways are awarded at Tier 1’s sole discretion and are subject to official rules and applicable laws.

Entries: Each point may entitle you to a specified number of entries in a giveaway. Winners are selected at random. No purchase or payment of points is required except where explicitly stated.
Prize Conditions: Prizes are non-transferable, non-negotiable, and non-refundable. No cash or other prize substitution is offeredtheginguide.com. In the event a prize becomes unavailable, Tier 1 may substitute a prize of equal or greater value. By participating in any giveaway, you release Tier 1 and its affiliates from all liability for any injury or loss resulting from the acceptance or use of any prize. Tier 1 may modify or cancel any giveaway or points program at any time, in its sole discretion.

Purchases and Payments

Tier 1 Sportsmen offers merchandise, products, and (if applicable) premium subscriptions for sale only to residents of the United States. All orders must ship to a U.S. address. We accept payment via credit/debit cards and other methods supported by our payment processor. Payments are processed through Stripe, a third-party payment service providerterms.liveit.io. By submitting payment information, you agree to Stripe’s terms and authorize Tier 1 (via Stripe) to charge your chosen payment method for applicable fees. Tier 1 does not store your full credit card number and is not responsible for Stripe’s handling of your payment data.

All prices are in U.S. dollars. You are responsible for any taxes or duties imposed on your purchase. Shipping, handling and delivery dates are estimates and not guaranteed. Because we cater only to U.S. customers, products ordered for international addresses will be canceled. All sales are final unless otherwise specified; refunds or exchanges (for defective or incorrect items) are at Tier 1’s discretion and will comply with applicable laws.

Third-Party Services

Tier 1 Sportsmen relies on various third-party services to operate the Site. These include, but are not limited to:

Stripe: Payment processing servicesterms.liveit.io. We use Stripe to handle transactions, and any payment disputes must be resolved directly with Stripe or Tier 1. Tier 1 is not responsible for Stripe’s policies or any errors in payment processing.
Mailchimp: Email communications and marketing. We may send newsletters, updates or promotional emails via Mailchimp. By subscribing or providing your email, you agree to Mailchimp’s terms and privacy practices.
Amazon Web Services (AWS): Hosting, storage and infrastructureterms.liveit.io. Our website and data are hosted on AWS servers. AWS’s terms and privacy policies govern their services, not Tier 1.
Google Analytics: Web analytics and tracking. We use Google Analytics to collect usage data (e.g., page visits). This helps us improve the Site. Google’s privacy policy applies to data collected through Google Analytics.
Sentry.io: Error and performance monitoring. Sentry collects anonymized error reports from our Site to help us diagnose issues. Sensitive information (like passwords) is removed before transmissionterms.liveit.io.

Tier 1 is not liable for any loss or damage arising from your use of these third-party services. You acknowledge that your use of any linked or integrated third-party service (e.g. external payment gateway, email provider, analytics service) is at your own risk and subject to that third party’s terms.

Prohibited Conduct

When using Tier 1 Sportsmen, you agree not to engage in any prohibited activities. Prohibited conduct includes, but is not limited to:

Illegal Activities: Any conduct that violates applicable law, regulation or rights of others (e.g. copyright, privacy, publicity).
Offensive Content: Posting or transmitting defamatory, obscene, hateful, harassing or discriminatory content.
Intellectual Property Infringement: Uploading or sharing content that infringes another’s copyright, trademark or other intellectual property rights.
Harassment/Threats: Stalking, bullying, intimidation, hate speech, or encouraging harm to others.
Spam and Fraud: Unsolicited bulk messages, chain letters, pyramid schemes, phishing, or fraudulent schemes. Sending spam or advertising without permission is forbidden.
Malicious Activity: Uploading viruses, malware, or any code intended to disrupt or damage the Site, servers or other users’ devices.
Site Interference: Denial-of-service attacks, overloading, spamming site features, or any attempt to disrupt the normal flow of the Site.
Unauthorized Access: Using robots, spiders, scrapers, or other automated means to access, monitor or copy data from the Site without permissiontermsfeed.com. Reverse-engineering or decompiling any software or code on the Site is also prohibitedtermsfeed.com.
Impersonation: Pretending to be another user or person, or falsely claiming an affiliation with Tier 1.

Tier 1 reserves the right to take appropriate action for violations of these rules, including warning, suspension, or termination of your account, and legal action.

User-Generated Content

Tier 1 Sportsmen allows users to post content (such as comments, forum posts, reviews, photos, or videos). You are solely responsible for any content you submit. Tier 1 does not endorse, verify or guarantee any user-generated content. Your views and opinions expressed in your content are your own and do not reflect those of Tier 1 or its affiliates. Tier 1 is not liable for any inaccuracies or issues arising from user contenttermsfeed.com.

By posting content, you grant Tier 1 (and its designees) a non-exclusive, royalty-free, worldwide license to use, copy, reproduce, distribute, and display your content on the Site and in promotional materials. You warrant that you have all rights necessary to grant this license. Your content must comply with these Terms; you agree not to post anything illegal or infringing. Tier 1 may remove or refuse any user content at any time, for any reason (e.g. content that violates these Terms or is otherwise objectionable)termsfeed.com.

You agree to indemnify and defend Tier 1 against any claims arising from your content or violations of the rules above. Tier 1 does not assume any obligation to monitor user content, but it reserves the right to do so.

Intellectual Property

All Site content (including text, graphics, logos, images, audio clips, videos, trademarks and software) is the property of Tier 1 Sportsmen or its licensors. No portion of the Site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without Tier 1’s prior written permission. Except for content you legally post yourself, you obtain no rights to any content from Tier 1 or other users.

Unauthorized use of the Site’s intellectual property (including screenshots, logos, or code) is illegal and constitutes infringementtermsfeed.com. If you infringe on another party’s intellectual property through our Site, we may terminate your access and you may be liable for damages.

Disclaimers

Tier 1 Sportsmen provides the Site and all content “as is” and for entertainment purposes only. To the fullest extent permitted by law, Tier 1 and Colby Enterprises LLC disclaim all warranties of any kind, whether express or implied. This includes (without limitation) warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and completenesstermsfeed.com. Tier 1 does not promise that the Site will be error-free, secure, or always available. Content on the Site may contain inaccuracies or typographical errors, and Tier 1 expressly disclaims liability for any such errors.

You agree that your use of the Site and services is at your own risk. Tier 1 is not responsible for (and disclaims liability for) any viruses or other malicious code that may infect your computer or device through your use of the Site. Tier 1 is also not responsible for the content, policies, or practices of any third-party websites linked from the Site. You assume all risks associated with using the Site and any information or content obtained through it.

Limitation of Liability

To the maximum extent permitted by law, Tier 1 and Colby Enterprises LLC (and their officers, directors, employees and agents) will not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use or inability to use the Site. This includes, without limitation, damages for lost profits, lost data, business interruption, or personal injury. In jurisdictions that do not allow the exclusion or limitation of liability for consequential damages, Tier 1’s liability will be limited to the greatest extent permitted by law.

In all events, Tier 1’s total liability for any claim arising out of these Terms or your use of the Site will not exceed the amount you have paid Tier 1 (if any) in the last twelve months.

Indemnification

You agree to defend, indemnify and hold harmless Tier 1 Sportsmen, Colby Enterprises LLC, and our affiliates, officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your content posted or made available through the Sitelatimes.com. Tier 1 reserves the right, at its own expense, to assume the exclusive defense and control of any claim subject to indemnification by you.

Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to sue. Except for small claims eligible for a court of limited jurisdiction, you and Tier 1 agree to resolve any dispute through binding arbitration rather than in courttermsfeed.com. Any arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) in the State of Texas. The arbitrator will apply Texas law and has the authority to grant any relief that a court could. The arbitrator’s award is final and binding, and judgment on the award may be entered in any court of competent jurisdiction. You and Tier 1 each waive the right to a jury trial and to participate in any class or representative actionlatimes.com. This means that disputes must be brought on an individual basis. If for any reason the arbitration and class action waiver cannot be enforced, you and Tier 1 agree that any unresolved dispute will be submitted to the state or federal courts in Texas.

Governing Law and Jurisdiction

These Terms and your use of the Site are governed by the laws of the State of Texas (without regard to conflict-of-law rules)cobrief.app. Any legal suit or proceeding relating to these Terms or the Site shall be brought exclusively in a state or federal court located in Orange County, Texascobrief.app. You consent to the personal jurisdiction of those courts for such purposes.

Changes to Terms

Tier 1 reserves the right to change or update these Terms at any time. When we do, we will post the updated Terms on this page and update the “Last Updated” date. If we make material changes, we will try to notify you (for example, by email or a notice on the Site). Your continued use of the Site after any changes constitute acceptance of the revised Termstermsfeed.com. You should review these Terms periodically for changes.
