Colby Enterprises, LLC (doing business as Tier 1 Sportsmen, “we,” “our” or “us”) operates this entertainment platform (website and mobile app) for U.S. hunting, fishing, and outdoors enthusiasts. Our Privacy Policy explains how we collect, use, share, and protect your personal information. We are committed to complying with all applicable U.S. privacy laws, including the California Consumer Privacy Act (“CCPA”), the Children’s Online Privacy Protection Act (“COPPA”), and FTC guidelines on consumer privacy. By using our Platform, you consent to the data practices described in this policy. If you do not agree, please do not use the Platform. This Platform is intended for adults 18 years or older. We do not knowingly collect personal data from anyone under age 13, and if we learn we have inadvertently obtained information from a minor, we will delete it



Information We Collect

We collect various types of personal information. “Personal Information” means any data that identifies or could be linked to an individual. Depending on how you use the Platform, we may collect:

Contact and Account Information: Such as your name and email address (provided when you register, subscribe to newsletters, or contact us).

Payment and Purchase Data: Details related to your orders or transactions (products or services you purchase on the Platform). We use Stripe to process payments, so credit card and billing information is collected by Stripe (and not stored on our servers). We may store order history and billing/shipping addresses for order fulfillment.

Device and Connection Information: Technical data collected automatically when you use the Platform, including your IP address, device type and identifiers, browser type and version, operating system, and mobile advertising identifiers.

Usage and Analytics: Information about how you use and interact with the Platform, such as pages visited, features used, search queries, and dates/times of access. We use Google Analytics (via Google Tag Manager) to collect and analyze this usage data. Analytics tools may collect or infer demographic or interest information to improve the service.

Location and Notifications (Mobile App): If you use our mobile app and grant permission, we may collect precise geolocation data (GPS) to provide location-based features. We will also collect a unique device token if you opt into push notifications. Location tracking and notifications are always subject to your explicit consent and can be disabled in your device settings.

Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to remember your preferences, enable certain features, and collect information about your browsing behavior. These may include session cookies, persistent cookies, and third-party cookies for analytics and advertising.

Communications: If you contact us (for support, feedback, etc.), we collect any information you provide, such as email address, inquiry content, or attachments.

We collect information directly from you (when you provide it) and automatically through your use of the Platform. We do not collect any sensitive personal information (e.g. Social Security numbers) beyond what is needed for payments, sweepstakes/contests IRS tax requirements, and identity verification.



How We Use Your Information

We use the information we collect for the following purposes:

To Provide and Operate the Service: We use your information to create and manage your account, deliver products or services you purchase, process payments (via Stripe), and facilitate your use of the Platform.

Communications: To send you transactional messages (order confirmations, account updates) and, if you have opted in, promotional emails or newsletters via Mailchimp. You can unsubscribe from marketing communications at any time by following the link in our emails or contacting us.

Personalization and Features: To personalize your experience, recommend content, and (with permission) send push notifications about new content or features.

Analytics and Improvement: To understand and analyze usage trends and improve the Platform. We aggregate and anonymize data when possible (e.g. creating usage statistics) to enhance performance and design.

Security and Legal Compliance: To detect and prevent fraud or abuse, enforce our Terms of Use, and comply with legal obligations. For example, we may use Sentry.io for error monitoring and debugging; Sentry collects crash reports and technical details, which help us fix bugs. We avoid sending sensitive personal data to Sentry and use its data scrubbing features when possible.

Other Business Uses: For internal research, audits, and business continuity. We do not use your personal data for purposes incompatible with the reason it was collected.

We do not sell or lease your personal information. We may share anonymized or aggregated data (which cannot be linked back to you) publicly or with third parties for marketing, advertising, or analytics.



Data Sharing and Third-Party Services

We share your personal information with the following types of third parties when necessary to fulfill the purposes described above:

Payment Processor: We share payment details (credit card number, billing info) with Stripe to process transactions. Stripe is PCI-compliant and handles sensitive payment data securely.

Email Service: We share contact information (name, email) with Mailchimp to send newsletters and promotional emails if you subscribe. Mailchimp’s use of data is governed by their privacy policy.

Analytics and Tagging: We share usage data with Google Analytics and use Google Tag Manager. These services collect information such as your IP address, pages visited, and click patterns. Google’s policies apply to that data.

Hosting and Infrastructure: Our Platform is hosted on Amazon Web Services (AWS). Your data (except encrypted payment data) is stored on AWS servers and protected under AWS’s security protocols.

Error and Crash Reporting: We use Sentry for monitoring application errors. Sentry receives limited technical data (e.g. stack traces, browser/device info). We do not intentionally send personal data to Sentry; any information collected is used to improve our software.

Legal and Safety: We may disclose personal information if required by law (e.g. subpoena, court order) or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business Transfers: In the event of a merger, acquisition, bankruptcy, or sale of assets, user information may be transferred as one of the business assets.

Service Providers: We may share data with vendors and partners who work on our behalf (such as customer support, marketing agencies, fraud protection services). All such third parties are contractually required to protect your information and use it only for authorized purposes.

We do not share or “sell” your personal information to advertisers or unrelated third parties for promotional purposes. Under the CCPA, “sale” is broadly defined to include many types of data sharing; we do not sell your data and we honor any opt-out request if that definition applies.



Your Choices and Rights

You have choices about the personal information you provide and certain rights under applicable law:

Access and Correction: You may update or correct the personal information in your account by editing your profile or by contacting us.

Deletion: You can request that we delete your account and associated personal data. To do so, contact us at command@tier1sportsmen.com or use the “delete account” feature if available. We will verify your identity and, if valid, delete your personal data from our systems (except any data we must retain by law). This includes deleting data from our service providers to the extent required by law.

Communications Opt-Out: You may opt out of marketing communications at any time by following the unsubscribe link or contacting us. You cannot opt out of service-related communications (like order confirmations).

Cookies: Most web browsers allow you to manage or disable cookies. If you disable cookies, some features of the Platform may not function properly. See the “Cookies and Tracking” section below for details.

California Privacy Rights: If you are a California resident, you have additional rights under the CCPAoag.ca.gov

Right to Know: You can request information about the categories of personal data we have collected about you and how it is used.

Right to Delete: You can request deletion of personal data we collected from you (subject to certain exceptions).

Right to Opt-Out: You have the right to opt out of any sale of your personal information. We do not sell your information.

Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

Cookies and Tracking

Essential Cookies: Required for basic Platform functions (e.g. logging in, security). You cannot opt-out of these.

Performance/Analytics Cookies: Tools like Google Analytics use cookies to collect usage statistics (page views, visit durations, etc.). These cookies do not identify you personally. You can disable analytics cookies by opting out via your browser settings or using Google’s opt-out tools.

Functionality Cookies: Remember your preferences (like language or region). These improve your experience but are not strictly necessary. You may disable them, but some features may not work.

Advertising/Marketing Cookies: We do not use advertising cookies on our own site. However, third-party partners (such as Mailchimp) may use cookies when you interact with our marketing emails. To opt out of such tracking, please follow the unsubscribes in those communications or consult the third party’s privacy settings.

Most browsers allow you to refuse or delete cookies (see your browser’s help menu). Note that if you block all cookies, you may not be able to use all features of the Platform.



Children’s Privacy

Our Platform is intended for adults 18 and older. In compliance with COPPA and our policies, we do not knowingly collect personal information from children under age 13. We do not provide content specifically directed to children. If we discover that we have inadvertently received information from a child under 13, we will immediately delete the data or obtain verifiable parental consent. Any user under 18 must have permission from a parent or guardian to use the Platform. If you believe we might have any information from a child, please contact us so we can take appropriate action.



Data Security

We use industry-standard measures to protect your data from unauthorized access, disclosure, or alteration. These include TLS encryption for data in transit and secure servers for data at rest (hosted with AWS). Access to personal data is limited to authorized employees and contractors. While we strive to use reasonable security practices, no system is completely secure. If a breach of your information occurs, we will notify affected individuals and authorities as required by law.



Changes to This Privacy Policy

We may update this Privacy Policy from time to time (for example, when adding new features or to comply with new legal requirements). When we make changes, we will revise the “Last Updated” date above. If the changes are significant, we will provide notice (by email or a prominent announcement on our Platform). We encourage you to review this Policy periodically for any updates. Your continued use of the Platform after changes are posted constitutes your acceptance of the new terms.
